VIOLENT CRIMES VICTIMS

More than 28 million people each year are victims of violent crimes. Violent crimes can change a person’s life instantly and forever. Victims are often permanently injured and suffer devastating losses that can last a lifetime, due to the violence they have suffered.

A "victim" is often defined as someone who is injured physically, dies, or suffers financial or emotional hardship due to injury incurred as a direct result of a crime.

In some cases, a state may provide relief and remedy to those people who have been victims of such crimes. For example, if such a crime may have been prevented by better security at an apartment complex or department store (perhaps if there was better lighting, security officers or cameras), the owners may be liable to you for damages you have incurred. In many cases, such owners may have had prior knowledge of violent criminal activity on their property and still did nothing to prevent future events, such as yours.

Victims can also file civil lawsuits against the perpetrator, or a responsible party to the crime, regardless of the outcome of the criminal case, or even if there was no criminal prosecution. Unlike the criminal justice process, the civil justice system does not determine an offender’s guilt or innocence and no one is sent to prison. Rather, civil courts access whether an offender (or other responsible party) is liable for the injuries sustained as a result of the crime. If liability is determined, a court may order the payment of monetary damages to the victims. While money can never fully compensate a victim for the trauma they have suffered, it does allow a victim to start rebuilding their lives. Additionally, such public exposure is a powerful incentive for those such as landlords and businesses to enact proper security measures necessary to keep their tenants safe in the future.

Some states provide victims of violent crimes financial compensation for expenses incurred such as medical care, psychological counseling, loss of support from a dependent, loss of wages, funeral and burial expenses, and other emergency expenses that were a result of the violent crime. Felony – A crime punishable by imprisonment of more than one year.

Capital Felony – A felony case in which the death penalty may be imposed. The alternative to such a sentence is life in prison.

Misdemeanor – Any crime, which is not a felony. Punishment is typically a fine or jail time of less than one year.
